CapitalShop Pty Ltd ACN 150 537 125 t/as Capital Consult (Capital Consult) is committed to ensuring your privacy through compliance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs). This privacy policy details how Capital Consult collects, uses, stores and deals with personal information.

What personal information do we collect, use and disclose?

In the course of conducting our business, we may collect a range of personal information from an individual including, amongst other things, their name, email addresses, business, mailing and residential addresses, business and home phone numbers, marital status, nationality and employment history. Capital Consult only collects personal information that is reasonably necessary for one or more of our functions or activities. It is not common practice for us to collect other more sensitive information about you, such as information about your religion, political opinions and affiliation, sexual preference, health status or criminal record, or information which may pose a greater financial or identification risk such as banking details, date of birth, driver’s licence or passport numbers. Capital Consult only collects sensitive information if it is reasonably necessary for Capital Consult’s functions or activities, or an exception applies under the Privacy Act and you have given your express consent to the collection.

How does Capital Consult collect the information?

We only collect personal information by lawful and fair means. Where reasonable and practical, we will usually collect your personal information directly from you, for example through website contact forms, emails or other correspondence, business cards, telephone conversations, consultations, and attendance at events. However, we may also collect information about you from third parties, for example through our referral network, from publicly maintained records or from other individuals or companies as authorised by you. We may also collect personal information about you where it is publicly available, for example through a company website or on social media. If we receive your unsolicited personal information which we would not otherwise have been able to collect through our usual methods outlined above, that information will usually be destroyed unless it is a Commonwealth record. Capital Consult will always take reasonable steps to ensure individuals are aware of the facts and circumstances of collection, the purpose of collection and information about Capital Consult’s privacy policy. If you do not provide the personal information requested by us, we may not be able to provide you with our products and services.

What does Capital Consult use personal information for?

We mainly use your personal information for the purpose for which it has been provided, which is usually so we can provide our products and services to you. This may include using your personal information for the following purposes:
  • to provide you with the products or services you requested;
  • to assist us in building, maintaining and managing our relationships with our customers, suppliers, contractors and employees;
  • informing customers and others about our products and services by our promotional activities, including direct marketing methods;
  • market research;
  • to assess, process and manage your application to work with us;
  • for complaints handling or data analytics purposes;
  • for administrative purposes in our business;
  • for complying with legal requirements; and

Our disclosures may include disclosure to overseas recipients.  If this is the case, we will take reasonable steps to ensure the overseas recipient complies with the Australian Privacy Principles. Where Capital Consult uses personal information other than for the purposes set out above, it will do so in accordance with the Privacy Act and APP 6.

Promotional activities and Direct Marketing

From time to time we may use your personal information to provide you with current information about our products and services, articles and other information you may find of interest, changes to our organisation, or new products or services being offered by us or any company we are associated with. By providing us with your personal information, you consent to us using your information to contact you on an ongoing basis for this purpose, including by mail, email, SMS, social media and telephone. If you do not wish to receive marketing information, you may at any time decline to receive such information by contacting our Privacy Officer using the contact details below. We will not charge you for giving effect to your request and will take all reasonable steps to meet your request at the earliest possible opportunity. Where Capital Consult engages in broad-scale direct marketing, it will offer the opportunity to unsubscribe from receiving direct marketing communications.

Access to and accuracy of personal information

Capital Consult takes all reasonable steps to ensure that the personal information it collects, uses and/or discloses is accurate, complete, up to date and relevant. You have the right to ensure that your personal information which is held by Capital Consult is accurate. To make a request to access and/or correct your personal information, please contact Capital Consult’s Privacy Officer using the contact details provided below. While Capital Consult will always endeavour to give access to personal information free of charge, Capital Consult reserves the right to charge individuals for access to personal information to cover costs associated with:
  • searching for, locating and retrieving personal information and deciding which information to provide to the individual;
  • using an intermediary; and
  • reproducing and sending the information.

Security of personal information

Capital Consult takes all reasonable steps to ensure that information held by Capital Consult is safe and secure, and that it is protected from misuse, loss, unauthorised access, modification and disclosure. Capital Consult stores and secures all personal information via a third party data storage provider. Capital Consult will make all reasonable endeavours to ensure the storage provider is compliant with the APP’s.

Destruction and de-identification of personal information

Capital Consult will take reasonable steps to de-identify or destroy personal information when it is no longer needed by Capital Consult except where the information forms part of a Commonwealth record or Capital Consult is required, by law or a court/tribunal order, to retain the information.

Anonymity and pseudonymity

You have the option of dealing anonymously or by pseudonym with Capital Consult unless it is impracticable to do so or Capital Consult is required, by law or a court or tribunal order, to deal with identified individuals.

Changes to privacy policy

Capital Consult reserves the right to amend this privacy policy from time to time. Changes will be posted on the Capital Consult website.

Complaints

If you believe there has been a breach of the APPs or an APP Code, please contact Capital Consult’s Privacy Officer using the details provided below. Capital Consult takes privacy complaints very seriously. If you make a complaint, Capital Consult will respond within 10 business days to let you know who is responsible for managing your complaint. Capital Consult will try to resolve your complaint within 15 business days. When this is not possible, Capital Consult will contact you within that time to let you know how long we will take to resolve your complaint. Capital Consult will investigate your complaint and where necessary, consult with third parties about your complaint. Capital Consult will make a decision about your complaint and write to you to explain our decision. Individuals can also complain directly to the Office of the Australian Privacy Commissioner.
